The following case has nothing yet everything to do with the cases of Dale, Akiel, and Sean. Cases of child sexual abuse, sexual assault, and murder, particularly of young boys, are more bounded by their similarities (background and foreground factors) than they are divided by their differences (perpetrator M.O., personation, and staging). 

BACKGROUND/VICTIMOLOGY:

  • victim, 9 year-old boy
  • lived at church-operated home for boys
  • offender, 16 year-old boy
  • both met at the home for boys
  • became aquainted
  • decided to hunt snakes and fish at nearby reservoir
  • as they sat fishing
  • offender (16) started fondling victim (9)
  • offender became sexually aroused
  • undid victim’s pants
  • offender started to perform fellatio on victim
  • offender tried to remove victim’s pants
  • victim resisted
  • offender turned him over on stomach 
  • tried to sodomize victim
  • they fell into water, struggle ensued
  • victim slipped on a rock, hit his head
  • victim became unconscious
  • offender tried to lift victim out of water
  • but slipped, dropping victim in water

 CRIME SCENE INDICATORS:

  • victim’s body found floating in reservoir
  • body wore no trousers

FORENSIC FINDINGS:

  • coroner’s exam revealed laceration 1.5 “ length and .5 ” width on forehead
  • multiple blows to the head

CAUSE OF DEATH:

  • asphyxiation by drowning

OFFENDER:

  • parents divorced when he was a few months old
  • elder brother beat him up constantly
  • lived with maternal grandfather who died 4 years later
  • grandfather’s death affect offender

OFFENDER WAS ALSO A VICTIM:

  • went fishing one day (age 11)
  • 18 year-old boy told him about a “better” fishing spot
  • older boy performed fellatio and sodomized him
  • he yelled but no one heard him, he felt helpless
  • the act was painful

EDUCATION:

  • in school, offender tested in high intelligence range
  • was advanced two grades
  • but socially immature
  • felt uncomfortable socialising with older boys

DELINQUENCY:

  • became rebellious and hostile
  • spent most of his life between 12-18 in juvenile detention centers and psychiatric facilities
  • racked up an extensive criminal record
  • four charges of sexual abuse of juveniles under age 14
  • he maintained that the victims were willing participants

OFFENDER CHARACTERISTICS:

  • offender began homosexual activities in his early adolescence
  • moved in with a male partner
  • six months later offender’s partner killed in an accident
  • offender attempts suicide
  • the assault of the boy at the reservoir happened on the anniversary of offender’s partner’s death

OUTCOME:

  • 18 year-old offender sentenced to 18-20 years for manslaughter and 18-20 years concurrent for rape
  • committed to the Massachusettes Treatment Center
  • as a sexually dangerous person with indefinite sentence
